ELIGIBILITY REQUIREMENTS FOR THE 132 BUSINESS TALENT VISA

Age: Under 55 years old. However, Australian states or territories may waive the age requirement if the applicant’s business activities provide exceptional benefits to the region where the business is proposed.
English Proficiency: IELTS score of 4.5 or PTE score of 30. If the applicant does not meet this requirement, an additional fee must be paid.
Nomination: Receive a nomination from an Australian state or territory before receiving an Invitation to Apply.
Demonstrate Successful Business Career: Show an overall successful business career and a desire to own and manage a business in Australia.
Business Ownership: For at least two of the four fiscal years before receiving an Invitation to Apply, the applicant and/or their spouse must have owned one or more businesses with net assets of at least 400,000 AUD. For publicly listed companies, only a 10% share of the issued capital is required.
Business and Personal Assets: The applicant and/or their spouse must have a minimum of 1,500,000 AUD in business and personal assets. These assets must be legally acquired and available for transfer to Australia within two years of being granted the 132 Visa.
Annual Business Revenue: Combined annual turnover of up to two businesses must be at least 3,000,000 AUD for two of the four fiscal years before receiving an Invitation to Apply. Ownership requirements include holding at least:
- 51% of a business with revenue under 400,000 AUD per year,
- 30% of a business with revenue over 400,000 AUD per year,
- or 10% of a publicly listed company.
Net Business Assets: The applicant and/or their spouse must have a minimum net asset of 400,000 AUD from ownership in one or more qualifying businesses, achieved in at least two of the four fiscal years before receiving the Invitation to Apply.

June 25, 2021: Client Q. established a business in Australia.
August 2, 2021: Client Q. moved to Australia with his family of four to live and operate the newly established business. Initially, he chose to export products such as nuts, wine, and raisins. However, after market research, we advised Client Q. to shift focus to seafood exports, as the original business plan was unlikely to meet the requirements for the 132 Visa.
June 6, 2023: After two years of operation, Client Q. received a Notice of Compliance Assessment for the conditions needed to qualify for the 132 Visa. At this time, Client Q.’s business revenue reached 722,957.03 AUD, far exceeding the required threshold.
June 20, 2023: Client Q. submitted his application to South Australia for nomination.
July 25, 2023: After receiving the nomination from South Australia, Client Q. proceeded to submit his 132 Visa application to the Australian Department of Home Affairs.
August 3, 2023: Client Q. received Certification 1010 and continued operating his business.
