CONDITIONS FOR GRANTING THE 132 BUSINESS TALENT VISA

Age: Under 55 years old. However, Australian states or territories may waive the age requirement if the applicant’s business activities provide exceptional benefits to the region they intend to operate in.
English Proficiency: IELTS 4.5 or PTE 30. If the applicant does not meet this requirement, they will need to pay an additional fee.
State/Territory Nomination: Must receive a nomination from an Australian state or territory before receiving an Invitation to Apply.
Proven Business Success: Applicants must demonstrate a successful business career and a desire to own and manage an Australian business.
Business Ownership: For at least 2 out of the 4 fiscal years before receiving the Invitation to Apply, the applicant and/or their spouse must have owned one or more businesses with a minimum net asset value of AUD 400,000. In the case of publicly listed companies, the applicant must own at least 10% of the issued capital.
Business Assets: The business assets of the applicant and/or their spouse must total at least AUD 1,500,000. These assets must have been legally acquired and be available for transfer to Australia within 2 years of being granted the 132 Visa.
Annual Revenue: The total annual turnover of up to two businesses must be at least AUD 3,000,000 for 2 out of the 4 fiscal years before receiving the Invitation to Apply for the 132 Visa. Ownership must include at least 51% of businesses with annual turnover under AUD 400,000, or at least 30% of businesses with turnover exceeding AUD 400,000, or at least 10% of publicly listed companies.
Net Business Assets: The applicant and/or their spouse must have a minimum net asset value of AUD 400,000 from ownership in one or more eligible businesses, achieved in at least 2 out of the 4 fiscal years before receiving the Invitation to Apply.

SI GROUP ACCOMPANIES CLIENT IN BUSINESS OPERATIONS

June 25, 2021: Client Q. established a business in Australia.
August 2, 2021: Client Q. brought their family of four to Australia to live and operate the newly established business. Initially, the client chose to engage in the export of nuts, wine, and raisins. However, after conducting a market survey, we identified that this business direction was not feasible to meet the requirements for the 132 Visa. Therefore, we advised Client Q. to shift towards the seafood export business.
June 6, 2023: After two years of operating the business, Client Q. received a letter proposing an inspection of the conditions required to qualify for the 132 Visa. At this time, Client Q.’s company revenue reached AUD 722,957.03, far exceeding the necessary threshold.
June 20, 2023: Client Q. submitted the application to South Australia for nomination.
July 25, 2023: After receiving the nomination from South Australia, Client Q. proceeded to submit the application for the 132 Visa to the Australian Department of Home Affairs.
August 3, 2023: Client Q. received certification 1010 and continued to operate the business.
